QA Assessor (“QA Assessor”, “we”, “us”, “our”) provides professional training and related services globally from our operations in London, United Kingdom and Uttar Pradesh, India.
By accessing our website, registering for a course or exam, using our Moodle LMS, joining our Zoom sessions or otherwise using our services (“Services”), you agree to be bound by these Terms and Conditions (“Terms”).
These Terms should be read together with our Privacy Policy and any specific course or exam instructions we provide. If you do not agree to these Terms, you should not use our Services.
In these Terms:
QA Assessor offers a range of Services, which may include:
Course descriptions, schedules and trainer details on our Website or brochures are provided in good faith but may be updated or improved at any time as part of our continuous enhancement of Services.
You can register for Courses via our Website, email, LinkedIn, WhatsApp or other channels made available by QA Assessor.
Your booking is considered confirmed when we have received your registration details and issued written confirmation, such as an email confirmation or invoice.
If you receive login details for platforms such as Moodle, you are responsible for keeping them confidential and not sharing them with others. Any activity under your account is your responsibility.
Some Courses, such as lead auditor training, require relevant prior knowledge, experience or qualifications. We may review your CV or profile to verify your competency before confirming your enrolment.
By enrolling, you confirm that the information you provide is accurate and that you meet any stated eligibility criteria. You agree to:
We may remove a learner from a Course or exam, without refund, in cases of serious misconduct, academic dishonesty, harassment or other material breach of these Terms.
Course and exam fees, together with any applicable taxes, will be communicated clearly on our Website, in proposals or in invoices before you confirm your booking.
Unless otherwise agreed in writing:
Payments may be made using the methods we accept from time to time, including Wise, PayPal and local bank transfers. You are responsible for any bank charges, transfer fees or currency conversion costs imposed by your payment provider.
If payment is not received by the due date, we may suspend or cancel your booking and withhold access to Course materials, exams or certificates until full payment is received.
If you wish to cancel or change your booking, you must notify us in writing (for example by email). The effective date of cancellation is the date we receive your written notice.
Specific cancellation, rescheduling and refund rules, including notice periods and any charges, will be stated on the relevant Course page, proposal or joining instructions. Where not otherwise stated, we will apply a fair and reasonable approach, taking into account our non‑recoverable costs and reserved trainer time.
Once you have attended significant portions of a Course, accessed substantial online content, or sat an exam, refunds may be partially or fully restricted. Once you have logged in to the LMS course, no refund will be provided.
We may need to cancel, reschedule or change the format of a Course or exam (for example due to low enrolments, trainer illness, technical issues or events beyond our reasonable control).
If we cancel a Course or exam, we will offer you either an alternative date/equivalent Course or a refund of the fees paid for the affected Service, unless an alternative arrangement is mutually agreed.
Our total liability for such cancellation or change will be limited to the amount of fees you have paid to QA Assessor for the affected Service.
Certain Courses may require you to attend a minimum number of hours or sessions and to complete assessments or examinations to be eligible for a certificate.
We will provide you with relevant joining instructions and exam rules, which may include requirements such as having your camera on during online exams, not using unauthorised materials and complying with invigilation instructions.
Certificates or records of achievement will be issued only when you have met the attendance and assessment requirements and all applicable fees have been paid in full. We reserve the right to withhold or revoke certificates in cases of proven fraud, impersonation or serious breach of exam rules.
You agree to use our Website, Moodle LMS, Zoom and any other platforms we provide solely for lawful purposes and in accordance with these Terms.
You must not attempt to gain unauthorised access to our systems, circumvent security features, interfere with the operation of our platforms or use them to distribute malicious code or offensive content.
We may suspend or restrict your access to our platforms if we reasonably suspect misuse, security risks or breach of these Terms.
All Course materials, slides, manuals, handouts, exam questions, recordings, Website content and other materials provided by QA Assessor or our trainers are protected by copyright and other intellectual property rights.
When you enrol in a Course, we grant you a personal, non‑exclusive, non‑transferable licence to use the materials solely for your own learning and professional development.
You must not copy, reproduce, modify, publish, distribute, sell, share, upload or exploit our materials or recordings in any way, except where we have given you prior written permission.
We use third‑party services such as Namecheap, IONOS, Moodle, Zoom, Microsoft Office, Mailjet, Wise, PayPal, LinkedIn and WhatsApp to deliver our Services and operate our Website.
These third parties have their own terms of use and privacy policies, which you may need to accept when using their services. We are not responsible for the content, security or privacy practices of third‑party websites or services.
Any links from our Website to third‑party sites are provided for convenience only and do not constitute an endorsement of those sites or their operators.
We handle personal data in accordance with applicable data protection laws in the UK and India, including UK data protection legislation and the Digital Personal Data Protection Act, 2023.
Our Privacy Policy explains how we collect, use, store and protect personal information and your rights. By using our Services, you acknowledge that you have read and understood our Privacy Policy.
We do not disclose, sell or rent personal information to any third party for their own independent commercial purposes. We use third‑party service providers only to support our Services, as described in our Privacy Policy.
We provide our Courses and Website using reasonable care and skill; however, we do not guarantee that completing a Course will result in any particular job outcome, promotion or professional success.
Our Website and online platforms are provided on an “as is” and “as available” basis. While we aim to minimise disruptions, we do not guarantee uninterrupted or error‑free access, or that defects will always be corrected promptly.
Any guidance, examples or information provided during training are for educational purposes only and do not constitute legal, financial or professional advice.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
To the fullest extent permitted by law, QA Assessor will not be liable for any indirect, incidental, consequential or special loss or damage, including loss of profit, revenue, business, opportunity, goodwill or data, arising out of or in connection with our Services or these Terms.
Subject to the above, our total aggregate liability for any claim arising out of or in connection with any Service will not exceed the total fees actually paid by you to QA Assessor for that specific Service.
We will not be liable for any delay or failure to perform our obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, lock‑outs, war, terrorism, government restrictions, major technical failures or power outages.
In such circumstances, we may reschedule Courses or adjust delivery (for example, moving to fully online formats) and will seek to minimise disruption where reasonably possible.
We may suspend or terminate your access to our Services and platforms, with immediate effect, if you materially breach these Terms, fail to pay fees when due, engage in fraud or misuse our systems or materials.
On termination, your right to access Courses, exams and platforms will cease. Any provisions of these Terms which by their nature should continue to apply (such as intellectual property, limitation of liability and governing law) will remain in effect.
If any provision of these Terms is held to be invalid or unenforceable by a court or competent authority, the remaining provisions will remain in full force and effect.
Our failure to exercise or enforce any right or provision under these Terms shall not constitute a waiver of that right or provision in future.
We may update these Terms from time to time, for example to reflect changes in our Services, legal requirements or business practices.
The version of the Terms in force at the time of your booking will normally apply to that booking, unless a change in law requires us to apply updated Terms.
The latest version of these Terms will be published on our Website with the “Last updated” date. Continued use of our Services after changes may indicate your acceptance of the updated Terms, where permitted by law.
For Services primarily contracted with our UK operations or delivered to learners in the UK, these Terms and any dispute or claim (including non‑contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.
For Services primarily contracted with our India operations or delivered to learners in India, these Terms and any dispute or claim shall be governed by and construed in accordance with the laws of India, and subject to the jurisdiction of the competent courts in Uttar Pradesh, India.
